Families in Transition (Homelessness)

Support is available for students and families experiencing homelessness. We ensure stability, access to education, and essential services under the McKinney-Vento Act. The term “homeless children and youth” is defined as individuals who lack a fixed, regular, and adequate nighttime residence.  This includes children and youth who are:

  • sharing the housing of others due to loss of housing or economic hardship
  • living in motels, hotels, trailer parks, campgrounds, or similar settings
  • Living in emergency or transitional housing
  • living in cars, parks, public spaces, abandoned buildings, or substandard housing

Federal Law - McKinney-Vento Homeless Assistance Act

This federal legislation was originally authorized in 1987 and most recently reauthorized in December 2015 by the Every Student Succeeds Act (ESSA). This legislation ensures children and youth experiencing homelessness have immediate and equal access to public education.

 

State Law – Texas Education Code

All Texas public schools, charter schools, and education services centers, collectively known as local education agencies (LEAs), must follow federal rules concerning the education of homeless students. Texas Education Code (TEC) §§ 25.001, 25.002, and 29.153 address educational rights for homeless students.

What is the McKinney-Vento Act?

The McKinney-Vento Act is a federal law that protects the educational rights of children and youth experiencing homelessness. It ensures students can enroll in school immediately, attend regularly, and receive support services—even without typical enrollment documents.

 

Who qualifies for support under McKinney-Vento?

Your child may qualify if your family is:

* Staying in a shelter or transitional housing

* Sharing housing due to economic hardship (doubled-up)

* Living in a motel, hotel, campground, or car

* Staying in substandard housing or public places

* An unaccompanied youth living without a parent or legal guardian

 

How can the McKinney-Vento Act help my child?

Eligible students may receive:

* Immediate enrollment in school

* Transportation assistance to the school of origin

* Free breakfast and lunch

* School supplies and clothing assistance

* Referrals to community resources and mental health support

* Support from the district McKinney-Vento Liaison

 

Can my child stay in their original school if we move?

Yes. If it's in your child’s best interest, they can stay in their school of origin—the school they were enrolled in before becoming homeless or the last school they attended—regardless of where your family moves.

 

How do I access McKinney-Vento services?

Contact your campus or the district’s McKinney-Vento Liaison. They will help determine eligibility, coordinate services, and connect your family to available resources.

 

Is my information kept confidential?

Yes. All information about your living situation is kept strictly confidential and only shared with school staff involved in providing services.

 

Does this program help with housing or rent?

 

No. The McKinney-Vento Act focuses on educational access and stability. However, the Liaison can help refer families to local housing and social service providers.

 

Can my preschool-aged child receive support?

Yes. Children in early childhood programs (Pre-K, Head Start, etc.) are also eligible for McKinney-Vento support.

 

What if I disagree with a school decision?

You have the right to appeal any decisions regarding eligibility, enrollment, or school placement. Your child has the right to enroll and receive services while the dispute is being resolved.
